Terms of service

Effective October 8, 2026

In short: BinRoster is $29 a month or $290 a year after a 30-day free trial. You can cancel any time and your plan runs to the end of the period you paid for. Your records belong to you. Payments from your customers go to your own Stripe account, and you are responsible for how you run your business and talk to your customers.

This summary is for convenience. The full terms below are what apply.

The agreement

These terms are an agreement between Jacob Hart ("BinRoster", "we", "us") and the business that creates a BinRoster account ("you"). They cover the BinRoster web application, driver app, booking pages, customer portal, API and related support (together, the "service").

By creating an account or using the service, you agree to these terms and to our privacy policy. If you accept on behalf of a business, you confirm that you have authority to bind it. The service is for business use, and you must be at least 18 years old to create an account.

Accounts and users

You can invite as many staff and drivers as you need. You are responsible for the people you invite, the roles you give them and everything done under your account. Keep sign-in details private, and tell us promptly at hello@binroster.com if you think your account has been used without permission. The account owner can remove a user at any time, which ends that person's access immediately.

Free trial

New accounts get a 30-day free trial with every feature and no payment method required. At the end of the trial you need a paid subscription to keep using the service. If you don't subscribe, we may limit your account to exporting your records.

Subscription and billing

  • The subscription costs $29 per month or $290 per year in US dollars, plus any applicable taxes, for each company account.
  • Subscriptions are billed in advance through Stripe and renew automatically at the end of each period until cancelled.
  • You can cancel at any time from Settings. Cancellation takes effect at the end of the period you have already paid for, and you keep full access until then.
  • Payments are non-refundable, including for partly used periods, except where the law requires a refund.
  • If a payment fails, we will tell you and try again. If it still can't be collected after a reasonable grace period, we may limit the account until it is paid.
  • We may change prices with at least 30 days' notice by email. A new price applies from your next renewal after the notice period.

Payments you collect

To take card or bank payments from your customers, you connect your own Stripe account. Payment processing is provided by Stripe and is subject to the Stripe Connected Account Agreement, which includes the Stripe Services Agreement. By connecting Stripe, you agree to those terms, and you authorize us to share information about you and your transactions with Stripe as needed to provide the service.

You are the seller in every transaction with your customers. Stripe pays out to your bank, and you pay Stripe's processing fees directly. BinRoster does not hold your funds and adds no fee to your payments. You are responsible for your prices, taxes, refunds, chargebacks and disputes, and for the accuracy of the rates and charges you set up.

Messages you send

The service can send emails and text messages to your customers on your behalf, such as confirmations, delivery updates, invoices and reminders. You are responsible for having the consent and permissions the law requires for the messages you send, including under the Telephone Consumer Protection Act and CAN-SPAM, and for honoring opt-outs. The service records text message consent and processes STOP requests automatically, and you must not work around those controls. We may pause messaging from an account to protect deliverability or to comply with carrier rules or the law.

SMS terms

These SMS terms apply to anyone who receives text messages sent through BinRoster, including customers of the dumpster rental companies that use the service.

  • Program. BinRoster rental service updates: transactional text messages about your own dumpster rentals, such as booking confirmations, delivery and pickup scheduling, driver en-route and job-completed notices, and invoice and payment reminders. We do not send marketing messages.
  • Opting in. You receive texts only if you agree to them, by checking the optional text message box on an online booking form or by turning on text notifications in the customer portal and confirming your number. Consent is not a condition of any purchase. See how opt-in works.
  • Message frequency varies with your rentals, typically a few messages per rental.
  • Message and data rates may apply.
  • Opting out. Reply STOP to any message to stop receiving texts. You will receive one message confirming that you are unsubscribed. Reply START to subscribe again.
  • Help. Reply HELP for help, or email hello@binroster.com.
  • Carriers are not liable for delayed or undelivered messages.
  • Your mobile number and text message consent are handled as described in our privacy policy.

Your data

You own the records you and your users put into the service ("your data"). You give us permission to store, copy and process your data only as needed to provide, secure and support the service, to meet legal obligations and as described in our privacy policy. We don't sell your data or use it for advertising.

You can export your data as CSV files at any time. After your account ends, you can still export your data for 30 days. After that we may delete it, except records we must keep for legal, tax or accounting reasons and copies in encrypted backups, which expire on their normal schedule.

Your customers and employees

You are responsible for giving your customers, drivers and other staff any notices the law requires about the information you keep about them, including that the driver app records location while a driver is on shift. You are also responsible for responding to their requests about their information. We will help where we reasonably can.

Acceptable use

You agree not to:

  • Use the service for anything unlawful, deceptive or harmful, or to send unwanted messages
  • Upload information you don't have the right to use
  • Try to get into another company's records, test or bypass our security, or disrupt the service
  • Copy, resell or reverse engineer the service, except where the law allows it
  • Use automated means to put an unreasonable load on the service; the API is for your own business records within its published limits

We may suspend access that breaks these rules or puts other users or the service at risk. Where practical, we'll tell you first and give you a chance to fix it.

Other services

Some features connect to services we don't control, such as Stripe, QuickBooks Online, email and text message carriers, and map providers. Your use of those services is governed by their own terms, and we aren't responsible for them. If a provider changes or stops its service, the related BinRoster feature may change or stop too.

Changes and availability

We improve the service regularly and may change or remove features. If we remove a feature you rely on in a way that materially reduces the service, we'll tell you in advance. We work to keep the service available and your data backed up, but we don't guarantee it will be uninterrupted or error-free, and we may need planned maintenance. Support is available by email at hello@binroster.com.

Cancellation and termination

You can cancel your subscription at any time as described above. We may end these terms or suspend the service if you materially break them and don't fix the problem within 15 days of our notice, or immediately where the law requires it or where continuing would cause serious harm. If we end the service for reasons other than your breach, we'll refund any prepaid amount for the unused part of your subscription. Sections on your data, disclaimers, limitation of liability, indemnity, governing law and general terms continue after these terms end.

Disclaimers

The service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title and non-infringement.

The service helps you run your business but doesn't replace your judgment. You are responsible for checking prices, taxes, invoices, routes, weights and dispatch decisions, and for safety, permits and placement on job sites. Arrival estimates and routes are estimates.

Limitation of liability

To the fullest extent the law allows, neither party will be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, even if told they were possible. Each party's total liability arising out of or relating to these terms is limited to the amounts you paid us for the service in the 12 months before the event giving rise to the claim.

These limits do not apply to your payment obligations, to either party's indemnity obligations, or to liability that the law does not allow to be limited.

Indemnity

You will defend and indemnify us against third-party claims arising from your data, the messages you send, your transactions with your customers, or your breach of these terms or the law. We will defend and indemnify you against third-party claims that the service, as we provide it, infringes their intellectual property rights. The party seeking indemnity must notify the other promptly, let it control the defense, and cooperate reasonably.

Governing law

These terms are governed by the laws of the State of Texas, without regard to its conflict of laws rules. Any dispute will be heard in the state or federal courts located in Texas, and both parties agree to their jurisdiction. Before filing a claim, each party agrees to try to resolve the dispute informally by contacting the other for at least 30 days.

General terms

  • Changes to these terms. We may update these terms. For material changes, we'll email the account owner at least 30 days before they take effect. Continuing to use the service after that means you accept the changes.
  • Notices. We send notices to the account owner's email address. You can send notices to hello@binroster.com.
  • Feedback. If you send us suggestions, we may use them without any obligation to you.
  • Assignment. Neither party may transfer these terms without the other's consent, except to a successor in a merger or sale of substantially all of its business.
  • Events beyond control. Neither party is responsible for delays caused by events outside its reasonable control.
  • Entire agreement. These terms and the privacy policy are the whole agreement between us about the service. If any part is unenforceable, the rest still applies. Not enforcing a term is not a waiver of it.
